These Terms of Service govern access to bamboorank.com and all advertising-management engagements between Bamboo Rank LLC and its clients. Read them in full before booking a call or signing an engagement contract.
01About these Terms
"Bamboo Rank", "we", "us", and "our" refer to Bamboo Rank LLC, a limited liability company registered in the State of Wyoming, United States, with operations conducted from Kuala Lumpur, Malaysia. "You", "your", and "Client" refer to the visitor or business entity engaging with Bamboo Rank.
Use of bamboorank.com constitutes acceptance of these Terms and the Privacy Policy. Where Bamboo Rank delivers paid services, additional terms are set out in a written engagement contract; in the event of conflict between these Terms and a signed engagement contract, the engagement contract prevails as to that engagement.
02Service description
Bamboo Rank provides managed Amazon advertising services for brand-owner sellers, including the design, launch, and ongoing optimisation of Sponsored Products, Sponsored Brands, and Sponsored Display campaigns across the Amazon marketplaces in which the Client is registered.
Service delivery is governed by Bamboo Rank's documented methodology, the 5-Step PPC Process, executed on a fixed 72-hour optimisation cadence using proprietary in-house tooling. The detailed scope of any engagement, including marketplaces covered, target metrics, reporting cadence, and exclusions, is set out in the relevant engagement contract.
03Engagement structure
Bamboo Rank operates retainer-based engagements. Each engagement begins with a written agreement signed by both parties, specifying:
- The Amazon marketplaces and products in scope;
- The monthly retainer fee, payment terms, and invoicing cadence;
- Target advertising metrics (target ACoS, TACOS, or revenue objectives) where measurable;
- The reporting cadence and the channels through which we communicate;
- The notice period applicable to either party.

Bamboo Rank engagements include a 60-day money-back guarantee. If, within the first 60 days of the engagement, you are not satisfied with the service for any reason, you may request a full refund of the retainer fees paid during that period. Direct advertising spend on the Amazon platform is not refundable, since those funds are paid to Amazon, not to Bamboo Rank.
Refund requests must be made in writing to contact@bamboorank.com within the 60-day window. Refunds are processed within 30 days of an approved request through the original payment method.
The guarantee is offered to make the engagement risk-free for the Client. It is not an excuse to withhold cooperation needed to deliver the service. Where a Client has prevented Bamboo Rank from performing the service in good faith, for example, by withholding necessary access, refusing to provide product information reasonably requested, or repeatedly cancelling onboarding sessions, Bamboo Rank reserves the right to decline a refund.
05Client responsibilities
To deliver the service, Bamboo Rank requires the Client to:
- Authorise advertising access through Amazon's Advertising Console invitation flow.
- Authorise selling-account access through Amazon's Seller Central "Manage Your Apps" flow, where Selling Partner API access is required for the engagement. The Client may revoke this authorisation at any time.
- Provide accurate product information and notify Bamboo Rank of significant catalogue changes (new SKUs, discontinuations, listing updates) within a reasonable timeframe.
- Maintain advertising eligibility on the Amazon platform, including listing health, account standing, sufficient inventory, and compliance with Amazon's seller policies. Bamboo Rank is not responsible for advertising performance affected by the Client's loss of eligibility.
- Pay invoices on the agreed schedule, separately from the Client's direct advertising spend with Amazon.
06Confidentiality
Both parties undertake to keep confidential any information shared in the course of the engagement that a reasonable person would understand to be confidential. This includes, but is not limited to: financial information, supplier and customer lists, product roadmaps, advertising performance data, and trade secrets.
Bamboo Rank handles Amazon seller data in accordance with the controls described on our Security & Compliance page. Confidentiality obligations survive termination of the engagement.
07Intellectual property
Bamboo Rank's methodology, optimisation rules, internal codebases, and proprietary tooling, including but not limited to the 5-Step PPC Process, the ABC Campaign Structure, and the Macro Runner automation system, remain the sole property of Bamboo Rank LLC. The Client receives the benefit of these in the form of the service delivered, but does not acquire ownership, license, or rights to redistribute them.
Conversely, the Client's product information, brand assets, and advertising-account data remain the sole property of the Client. Bamboo Rank does not claim any rights in this material beyond what is necessary to perform the service.
Where Bamboo Rank produces written reports or analyses for the Client during the engagement, the Client receives a perpetual licence to use those documents internally. Bamboo Rank may retain anonymised, aggregated insights derived from the engagement for purposes of methodology refinement.
08Performance, results, and forward-looking statements
Amazon advertising results depend on many variables outside Bamboo Rank's control, including product quality, listing optimisation, pricing competitiveness, inventory availability, marketplace dynamics, seasonality, the actions of competitors, and changes to Amazon's advertising platform. Bamboo Rank does not guarantee specific levels of sales, ACoS, TACOS, return on advertising spend, or other performance outcomes.
Case studies, testimonials, and historical results published on bamboorank.com describe outcomes achieved for specific clients in specific contexts. They are not promises of comparable outcomes for any other Client. Forward-looking statements made during sales conversations or in proposals are estimates based on the information available at the time and should not be construed as commitments.
09Termination
Either party may terminate the engagement on the notice period specified in the engagement contract (typically 30 days). Termination is without prejudice to any obligations accrued before the effective termination date, including the obligation to pay outstanding invoices for services already rendered.
Bamboo Rank may suspend or terminate the engagement immediately, on written notice, if the Client:
- Fails to pay an invoice when due, more than 14 days after written reminder;
- Loses Amazon advertising eligibility for reasons attributable to the Client;
- Engages in conduct that would expose Bamboo Rank to a violation of Amazon's policies or applicable law;
- Is the subject of insolvency or analogous proceedings.
On termination, Bamboo Rank's authorisation in the Client's advertising and selling accounts is revoked by the Client through the relevant Amazon flows. Bamboo Rank deletes Client-specific operational data within 30 days of termination, in line with the Security & Compliance retention policy.
10Limitation of liability
To the maximum extent permitted by applicable law, Bamboo Rank's total aggregate liability arising out of or in connection with any engagement is limited to the total fees paid by the Client to Bamboo Rank in the three months immediately preceding the event giving rise to the liability.
Bamboo Rank is not liable for indirect, consequential, incidental, or punitive damages, including loss of profits, loss of revenue, loss of business opportunity, or reputational harm, even if Bamboo Rank has been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
11Indemnification
The Client agrees to indemnify Bamboo Rank against claims, losses, or expenses arising from: (a) the Client's products, listings, or brand content infringing the rights of any third party; (b) the Client's breach of Amazon's seller or advertising policies; (c) the Client's misrepresentation of product information provided to Bamboo Rank for use in advertising creative.
12Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute arising out of or in connection with these Terms, save that nothing prevents either party from seeking injunctive or equitable relief in any other competent jurisdiction to protect its confidential information or intellectual property.
For Clients resident in the United Kingdom or the European Union, this clause does not affect any mandatory consumer protections available under the law of the Client's country of residence, where such protections apply.
13Changes to these Terms
Bamboo Rank may revise these Terms from time to time. Material changes are communicated to active Clients in writing at least 30 days before they take effect. The "Last updated" date at the top of this page is always current. Continued use of bamboorank.com or continuation of the engagement after the effective date of a revision constitutes acceptance of the revised Terms.
